For all questions about data protection, you can reach us at datenschutz@mavie.world.
3. Hosting and server log files
This website is hosted by Netlify, Inc., 512 2nd Street, Suite 200, San Francisco, CA 94107, USA. Netlify delivers the website via a global content delivery network, so data may also be processed in the USA. A data processing agreement pursuant to Art. 28 GDPR is in place with Netlify. Netlify is certified under the EU-U.S. Data Privacy Framework; transfers to the USA are based on the European Commission's adequacy decision (Art. 45 GDPR).
When you access the website, the following information is automatically stored in server log files:
- truncated IP address
- date and time of access
- name and URL of the file retrieved
- volume of data transferred and confirmation of successful retrieval
- browser type, browser version and operating system
The purpose is the secure and trouble-free operation of the website. The legal basis is Art. 6 (1) (f) GDPR. Log files are deleted after 14 days.
4. Cookies and local storage
This website uses no analytics, tracking or marketing cookies. For the language selection (DE/EN), we store a technically necessary setting in your browser's local storage. This information does not leave your device. The legal basis is § 25 (2) no. 2 TDDDG. You can delete the setting at any time via your browser.
5. External content and fonts
This website does not embed any content, scripts or fonts from third parties. All fonts are loaded locally from our server. Visiting the website does not establish a connection to servers operated by Google or any other third party.
6. Enquiries and demo requests
If you contact us by email, by phone or via the demo form, we process the data you provide (e.g. name, institution or provider, role, email address, phone number, federal state, number of children and your message) in order to handle your enquiry and, where applicable, to hold a demo.
The legal basis is Art. 6 (1) (b) GDPR where your enquiry is aimed at concluding a contract, and otherwise Art. 6 (1) (f) GDPR (legitimate interest in responding to enquiries).
Submissions via the demo form are received and stored through the form service of our hosting provider Netlify, Inc. (see section 3). The data may be processed in the USA in the process.
To send system emails, we use rapidmail, a service of Positive Group Deutschland GmbH, Ingeborg-Krummer-Schroth-Straße 18a, 79106 Freiburg im Breisgau, Germany; a data processing agreement is in place with this provider.
We delete your data once your enquiry has been dealt with conclusively, and at the latest 12 months after the last contact if no contract is concluded. Statutory retention obligations (in particular under the German Commercial Code (HGB) and Fiscal Code (AO)) remain unaffected.
7. Processing on behalf of Kita providers (MAVIE software)
Where Kita providers use the MAVIE software, we process personal data of children, parents or legal guardians and staff exclusively on behalf of, and in accordance with the documented instructions of, the respective provider (Art. 28 GDPR). The provider is the controller for this data. Data subjects should direct enquiries about this data to their Kita or its provider; we support the provider in fulfilling data subject rights.
The basis for this is a data processing agreement (DPA) including the technical and organisational measures (TOMs). The MAVIE software is operated by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, exclusively in data centres in Germany. Sub-processors used are listed in the DPA; we inform providers in advance of any planned changes so that they can object. We do not sell data and do not use it for advertising purposes.
We make the DPA and TOMs available to interested providers on request at datenschutz@mavie.world.
8. Recipients
We only pass on personal data to the service providers named above who act on our behalf, and to authorities where we are legally obliged to do so.
9. Transfers to third countries
Through Netlify's hosting of this website and its handling of demo form submissions, data may be transferred to the USA (see sections 3 and 6). Beyond this, personal data is not transferred to countries outside the European Union or the European Economic Area. Data processed in the MAVIE software does not leave the European Union.
10. Retention period
We store personal data only for as long as is necessary for the purposes stated or as required by statutory retention periods.
11. Your rights
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20). You can withdraw any consent you have given at any time with effect for the future.
Right to object: Where we process data on the basis of Art. 6 (1) (f) GDPR, you may object at any time on grounds relating to your particular situation (Art. 21 GDPR).
To exercise your rights, an email to datenschutz@mavie.world is sufficient.
You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is:
Berliner Beauftragte für Datenschutz und Informationsfreiheit (Berlin Commissioner for Data Protection and Freedom of Information)
Alt-Moabit 59–61, 10555 Berlin
12. No automated decision-making
We do not use automated decision-making, including profiling, within the meaning of Art. 22 GDPR.
13. Data security
Data is transmitted in encrypted form via TLS. Access to personal data is restricted on a role basis and is logged.
14. Changes to this privacy policy
We update this privacy policy when our processing activities or the legal situation change. The version published on this website at any given time applies.
