Nutzen Kitas MAVIE als Software, verarbeiten wir personenbezogene Daten von Kindern, Eltern und Beschäftigten ausschließlich im Auftrag und nach Weisung der jeweiligen Kita. Grundlage ist ein Vertrag zur Auftragsverarbeitung nach Art. 28 DSGVO. Verantwortlich für diese Daten bleibt die Kita.

7. Speicherdauer

Wir speichern personenbezogene Daten nur so lange, wie es für die genannten Zwecke erforderlich ist oder gesetzliche Aufbewahrungsfristen (insbesondere aus HGB und AO) es vorschreiben.

8. Deine Rechte

Du hast das Recht auf Auskunft (Art. 15), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung der Verarbeitung (Art. 18), Datenübertragbarkeit (Art. 20) sowie Widerspruch gegen die Verarbeitung (Art. 21 DSGVO). Eine erteilte Einwilligung kannst du jederzeit widerrufen. Zudem steht dir ein Beschwerderecht bei einer Aufsichtsbehörde zu — für uns zuständig ist die Berliner Beauftragte für Datenschutz und Informationsfreiheit.

9. Datensicherheit

Die Übertragung erfolgt verschlüsselt über TLS. Zugriffe auf personenbezogene Daten sind rollenbasiert beschränkt und werden protokolliert.

We process personal data only to the extent necessary to provide a functioning website and our content and services. Processing is based on Art. 6 (1) GDPR — in particular consent (lit. a), performance of a contract (lit. b), compliance with legal obligations (lit. c) and our legitimate interests (lit. f).

All data is processed exclusively on servers located in Germany. No transfer to third countries takes place.

3. Hosting and server log files

When you access this website, our hosting provider automatically stores information in server log files:

  • the truncated IP address of the requesting device
  • the date and time of access
  • the name and URL of the file retrieved
  • the volume of data transferred and confirmation of successful retrieval
  • browser type, browser version and operating system

The legal basis is Art. 6 (1) lit. f GDPR; our legitimate interest lies in the secure and trouble-free operation of the website. Log files are deleted after 7 days.

4. Cookies and local storage

This website uses no tracking or marketing cookies. For the language selection (EN/DE) we store a technically necessary setting in your browser's local storage. This information does not leave your device and can be deleted at any time via your browser settings.

5. Enquiries and demo requests

If you contact us by email, form or telephone, we process the data you provide (name, contact details, content of your enquiry) in order to handle your request. The legal basis is Art. 6 (1) lit. b or lit. f GDPR. The data is deleted once your enquiry has been dealt with conclusively and no statutory retention obligations apply.

6. Processing on behalf of Kitas

Where Kitas use MAVIE as software, we process the personal data of children, parents and staff exclusively on behalf of and on the instructions of the respective Kita. The basis for this is a data processing agreement pursuant to Art. 28 GDPR. The Kita remains the controller for that data.

7. Retention period

We store personal data only for as long as is necessary for the purposes stated, or for as long as statutory retention periods (in particular under the German Commercial Code and Fiscal Code) require.

8. Your rights

You have the right to access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing (Art. 21 GDPR). You may withdraw any consent given at any time. You also have the right to lodge a complaint with a supervisory authority — the authority responsible for us is the Berlin Commissioner for Data Protection and Freedom of Information.

9. Data security

Data is transmitted in encrypted form via TLS. Access to personal data is restricted on a role basis and is logged.

§ 1 Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Verträge zwischen der MAVIE Family UG (haftungsbeschränkt) i. Gr., Eschersheimer Straße 51, 12099, Berlin (nachfolgend „MAVIE“) und ihren Kunden über die Bereitstellung der MAVIE-Software als Software-as-a-Service. Abweichende Bedingungen des Kunden werden nur wirksam, wenn MAVIE ihnen schriftlich zustimmt.

§ 2 Vertragsgegenstand

MAVIE stellt dem Kunden die jeweils gebuchten Module der MAVIE-Plattform über das Internet zur Nutzung bereit. Ein Anspruch auf Überlassung des Quellcodes besteht nicht. Der jeweilige Funktionsumfang ergibt sich aus der Leistungsbeschreibung zum Zeitpunkt des Vertragsschlusses.

§ 3 Vertragsschluss

Die Darstellung der Leistungen auf der Website stellt kein bindendes Angebot dar. Der Vertrag kommt durch Annahme des Angebots von MAVIE oder durch Freischaltung des Zugangs zustande.

§ 4 Verfügbarkeit

MAVIE stellt eine Verfügbarkeit von 99,5 % im Jahresmittel bereit. Ausgenommen sind angekündigte Wartungsfenster sowie Zeiten, in denen die Plattform aus Gründen außerhalb des Einflussbereichs von MAVIE nicht erreichbar ist.

§ 5 Preise und Zahlung

Es gelten die bei Vertragsschluss vereinbarten Preise, zuzüglich der gesetzlichen Umsatzsteuer. Die Abrechnung erfolgt im Voraus. Rechnungen sind innerhalb von 14 Tagen ohne Abzug zur Zahlung fällig.

§ 6 Pflichten des Kunden

Der Kunde ist verpflichtet, Zugangsdaten geheim zu halten, seine Nutzerkonten aktuell zu führen und die Plattform nicht rechtswidrig zu nutzen. Der Kunde bleibt datenschutzrechtlich Verantwortlicher für die von ihm eingestellten Daten.

§ 7 Datenschutz und Auftragsverarbeitung

Die Parteien schließen einen Vertrag zur Auftragsverarbeitung gemäß Art. 28 DSGVO. Die Verarbeitung erfolgt ausschließlich auf Servern in Deutschland.

§ 8 Laufzeit und Kündigung

Der Vertrag läuft, sofern nicht anders vereinbart, 12 Monate und verlängert sich jeweils um denselben Zeitraum, wenn er nicht mit einer Frist von drei Monaten zum Laufzeitende gekündigt wird. Das Recht zur Kündigung aus wichtigem Grund bleibt unberührt.

§ 9 Datenexport nach Vertragsende

Nach Vertragsende stellt MAVIE dem Kunden die von ihm eingestellten Daten für 30 Tage in einem maschinenlesbaren Format zum Export bereit. Danach werden die Daten gelöscht, soweit keine gesetzlichen Aufbewahrungspflichten bestehen.

§ 10 Haftung

MAVIE haftet unbeschränkt für Vorsatz und grobe Fahrlässigkeit sowie bei Verletzung von Leben, Körper oder Gesundheit. Bei einfacher Fahrlässigkeit haftet MAVIE nur bei Verletzung einer wesentlichen Vertragspflicht und begrenzt auf den vorhersehbaren, vertragstypischen Schaden.

§ 11 Änderungen dieser AGB

MAVIE kann diese AGB mit einer Frist von sechs Wochen zum Monatsende ändern. Widerspricht der Kunde nicht innerhalb dieser Frist, gelten die Änderungen als angenommen. Auf das Widerspruchsrecht wird in der Mitteilung gesondert hingewiesen.

§ 12 Schlussbestimmungen

Es gilt deutsches Recht. Gerichtsstand ist Berlin, soweit der Kunde Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen ist. Sollten einzelne Bestimmungen unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

§ 1 Scope

These general terms and conditions (GTC) apply to all contracts between MAVIE Family UG (haftungsbeschränkt) i. Gr., Eschersheimer Straße 51, 12099, Berlin (hereinafter "MAVIE") and its customers concerning the provision of the MAVIE software as software-as-a-service. Deviating terms of the customer only become effective if MAVIE agrees to them in writing.

§ 2 Subject matter

MAVIE provides the customer with the modules of the MAVIE platform booked in each case for use over the internet. There is no entitlement to the release of source code. The scope of functions is set out in the service description applicable at the time the contract is concluded.

§ 3 Conclusion of contract

The presentation of services on the website does not constitute a binding offer. The contract is concluded upon acceptance of MAVIE's offer or upon activation of access.

§ 4 Availability

MAVIE provides availability of 99,5 % on annual average. Announced maintenance windows and periods in which the platform is unavailable for reasons outside MAVIE's control are excluded.

§ 5 Prices and payment

The prices agreed at the time of conclusion of the contract apply, plus statutory VAT. Invoicing takes place in advance. Invoices are payable in full within 14 days.

§ 6 Customer obligations

The customer is obliged to keep access credentials confidential, to keep user accounts up to date and not to use the platform unlawfully. The customer remains the controller under data protection law for the data it enters.

§ 7 Data protection and processing on instruction

The parties shall conclude a data processing agreement pursuant to Art. 28 GDPR. Processing takes place exclusively on servers located in Germany.

§ 8 Term and termination

Unless otherwise agreed, the contract runs for 12 months and is extended by the same period each time unless terminated with drei months' notice to the end of the term. The right to terminate for good cause remains unaffected.

§ 9 Data export after the end of the contract

After the end of the contract, MAVIE makes the data entered by the customer available for export in a machine-readable format for 30 days. The data is then deleted unless statutory retention obligations apply.

§ 10 Liability

MAVIE is liable without limitation for intent and gross negligence, as well as for injury to life, body or health. In cases of simple negligence, MAVIE is liable only for breach of a material contractual obligation and limited to foreseeable damage typical of this type of contract.

§ 11 Changes to these GTC

MAVIE may amend these GTC with six weeks' notice to the end of a month. If the customer does not object within this period, the changes are deemed accepted. The right to object will be pointed out separately in the notification.

§ 12 Final provisions

German law applies. The place of jurisdiction is Berlin, provided the customer is a merchant, a legal entity under public law or a special fund under public law. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
